Start with the BAA and privacy obligations

For a US practice, no AI receptionist contract is complete without a signed Business Associate Agreement. The vendor will hear protected health information on every call, which makes them a business associate under HIPAA, and the BAA should spell out permitted uses of PHI, breach notification duties, and what happens to data when the agreement ends. Read the BAA itself, not just the marketing page that mentions HIPAA. Canadian practices should look for language addressing PIPEDA, and PHIPA if you operate in Ontario; Australian practices should confirm the vendor's obligations under the Privacy Act and the Australian Privacy Principles. The contract should answer four questions plainly. Where is call data stored, and in which jurisdiction? How long are recordings and transcripts retained, and can you shorten that window? Who inside the vendor can access patient conversations, and under what controls? And, critically, is your patients' call data used to train models beyond serving your practice? Vague answers here are a warning sign, because every call an AI receptionist takes contains names, symptoms, medications, and callback numbers. Also check what the system is contractually permitted to do. Most important: confirm you can export your call summaries and transcripts in a usable format, and that the vendor will delete PHI after offboarding, with the BAA or privacy schedule saying so explicitly. Then bring a short question list to every vendor conversation. Will you sign a BAA, or the equivalent commitments for Canada and Australia? Is our data used for model training?
